Protecting Your Brand in the Rush to Register Adult Industry – .XXX – Domain Names

As a result of a recent decision by the international body that manages domain names, trademark owners are strongly encouraged to protect their trademarks from being usurped by an adult entertainment provider. Such a provider could, absent action by the trademark owner, use the trademark as part of such adult entertainment provider’s domain name.

Earlier this year, the Internet Corporation for Assigned Names and Numbers approved .XXX as a new sponsored suffix (“top level domain” or “TLD”) in addition to well-known TLDs such as.com, .net, and .org, for adult entertainment providers. ICM Registry, responsible for operating the .XXX TLD, announced that the registration process will begin next month, and trademark owners need to consider what they should do to protect their marks.
