Commission reforms antitrust procedures and expands role of Hearing Officer

On 20 October 2011, the European Commission (“Commission”) published in the Official Journal its Notice on Best Practices for the conduct of proceedings concerning Articles 101 and 102 TFEU (“Best Practices Notice”). The objective of the Best Practices Notice is to provide guidance on the day-to-day conduct of proceedings before the Commission in the context of Article 101 TFEU (prohibition on anticompetitive agreements, including cartels) and Article 102 TFEU (prohibition on abuse of a dominant position). The Best Practices Notice also reflects the new Commission Decision on the function and terms of reference of the Hearing Officer in competition proceedings (see IP/11/201). According to the Commission, the package of measures aims to increase the transparency and fairness of proceedings and strengthen the procedural rights of the parties under investigation (see MEMO/11/703).
