Since the start of the “green revolution,” it has been expected that litigation would result from green construction; and most early legal commentary focused on the likelihood of green construction disputes. Yet, green cases are likely to arise in many areas outside construction, some unexpected. Also, because of the reach of green issues, these lawsuits can quickly involve more parties than the usual litigants in a construction dispute.
