Court Stays Implementation of Cross-State Air Pollution Rule

On Friday, December, 30, 2011, the U.S. Court of Appeals for the District of Columbia Circuit granted motions to stay the U.S. Environmental Protection Agency’s Cross-State Air Pollution Rule (CSAPR). The stay delays the scheduled January 1, 2012 implementation of CSAPR, pending completion of the court’s review of the legal challenges to the rule. In its order, the court also granted expedited review and ordered the parties to submit proposed briefing formats and schedules based on an April 2012 date for oral argument.
