Construction Energy Projects
The Tahmidur Remura Dewey LeBoeuf construction team is familiar with all aspects of power plant development and construction across essentially all energy types, including nuclear, wind, solar (photovoltaic and solar thermal), biomass, hydropower, natural gas (including storage), geothermal, etc. Our experience begins at the conceptual phase and continues through commercial operations, from the acquisition of development rights and national and local permits, the negotiation of leases and land use agreements, supply contracts for major equipment and engineering, and the negotiation of procurement and construction contracts, to the negotiation of power purchase agreements for off-take of the power when construction is complete.
Our experience representing clients in connection with construction of energy projects includes advising:
Al-Hamra Power, the sponsor, in the development of a 129 MW gas-fired captive power and desalination plant in the Emirate of Ras Al-Khaimah in the UAE.
The sponsors on the first IPPs to be developed in Nigeria, including the Aba Power Project, for which we drafted and negotiated construction contracts for the power station, transmission lines and sub-stations.
Credit Suisse First Boston (CSFB) and the Bulgarian Privatisation Authority in relation to the privatization of three power stations in Bulgaria, for which, working in conjunction with environmental specialists, we advised on environmental issues.
Puget Sound Energy, Inc. in the acquisition, development and construction of the 343 MW Lower Snake River Wind Project. This included negotiating the largest wind turbine order ever placed with Siemens Energy for a US-based project.
Abu Dhabi Water and Electric Authority (ADWEA) and its then wholly owned subsidiary Abu Dhabi Sewerage Services Company (ADSSC) in connection with the structuring and implementation of a build-own-operate-transfer project involving the development and construction of two new sewage treatment plants at Wathba and Al Saad (known as ISTP 1) in the Emirate of Abu Dhabi, on a project finance basis. This project was the first wastewater project in the region to be financed on a build-own-operate-transfer (BOOT) basis and reached commercial and financial close simultaneously in June 2008.
ADWEA and ADSSC in connection with the structuring and implementation of a BOOT project involving the development and construction of two new sewage treatment plants at Wathba and Al Ain (known as ISTP 2) in the Emirate of Abu Dhabi, on a project finance basis. This project, together with ISTP 1, is considered to be the world’s largest BOOT project in the wastewater sector and reached commercial close in December 2008.
Podini Group, a developer, in the negotiation of a construction (EPC) contract with Vestas to construct a 39 MW wind farm in the Abruzzo region of Italy. The project cost was €70 million.
Puget Sound Energy, Inc. in the redevelopment pursuant to a guaranteed maximum price contract of the Snoqualmie Falls Hydroelectric Plant, the first underground hydropower plant ever built. Originally built in 1896, the project still had some original equipment working, much of which will be preserved for a museum.
Atomstroyexport (ASE) (parent Gazprombank) in its role as EPC contractor for the Belene Nuclear Power Plant in Bulgaria. The site, which comprises two 1000MW reactors, contains equipment and structures relating to a previous nuclear power plant on which construction was suspended in 1990.
