Order No. 720 implements section 23 of the Natural Gas Act (NGA), 15 U.S.C. § 717t-2, which authorizes FERC to “facilitate price transparency in markets for the sale or transportation of physical natural gas in interstate commerce.” Section 23, added to the NGA by the Energy Policy Act of 2005, also gives FERC responsibility for collecting and disseminating “information about the availability and prices of natural gas at wholesale and in interstate commerce.” These informational posting requirements are yet another step in the direction of increasing public access to transportation or transmission related information. Smart Grid investments are expected to apply digital technologies to the grid and enable real-time coordination of information from generation supply resources, demand resources and distributed energy resources, to increase the efficiency of the grid and result in savings in the provision of electric service. The FCC’s revisions significantly modify the prior federal pole attachment rules. While renewable energy sources continue to garner interest from the investment community, currently the most economic and reliable source of domestic energy (other than coal) appears to be natural gas. For example, one of the largest “unconventional” on-shore natural gas deposits in the world is in a geologic formation known as the Marcellus Shale located beneath parts of New York, Pennsylvania, Ohio, Maryland, West Virginia and other states. Significant natural gas deposits are also located in various other shale formations throughout the United States, including in Louisiana, Arkansas, Texas, Oklahoma, Colorado and Utah. Some were monitoring this FERC proceeding to see whether changes to FERC’s approach to analyzing market power would have any effect on two large transactions currently pending before FERC – the proposed Constellation-Exelon merger and the proposed Duke-Progress merger.
